Seek Council Approval

Once you accept your quote, we start drafting your construction plans, organising building insurances and lodging the paperwork with council for approval.

Please note that relaxations and town planning applications can take quite a while longer; however, we’ll keep you informed along the way.

Do you need council approval for a pergola?

You don’t generally need council approval in New South Wales to build a pergola. As long as you meet certain conditions – such as your structure having a footprint of less than 25 square metres (and, for lots of 300 square metres or more, less than 15% of your home’s footprint) and being located at least 900 millimetres from a boundary – your structure is classed as an exempt development.

If you do need approval, we’ll liaise with the Tweed Shire Council on your behalf before building commences. You don’t need to do anything.

How much does it cost to build a pergola in Tweed Heads?

The cost of a pergola varies. If you’re happy with a simple softwood arbour, expect to pay $3,000–$4,000 for materials and installation. For a more complex pergola with features like a covered roof, you could pay up to $12,000. Our average client spends around $18,000, although that often includes a new patio deck and an insulated pergola with lighting.

What’s the difference between a pergola, an arbour, a pavilion, a gazebo, and a patio covering?

Many people use those terms interchangeably, but here’s how we define them.

A pergola is an attached or freestanding structure with at least 4 pillars or posts that covers a patio or path.
It can be open (often, partially shaded by vines) or covered with a gable or skillion roof.

An arbour is a type of roofless pergola with overhead lattices or joists. It’s typically designed to be covered in vines like wisteria or jasmine.

A patio covering is any pergola installed over a patio (an unraised, floored outdoor space designed for sitting and entertaining).

A pavilion is a standalone patio covering that isn’t connected to a main structure like a house.

A gazebo is a type of pavilion. It’s typically smaller, features a circular or hexagonal/octagonal roof, and is normally located in a garden setting. Many gazebos also have railings, elevated patios, and cupolas.

What warranties do you offer?

We offer an 6.5-year structural warranty and a 15-year materials warranty on all new builds. Individual parts and materials may have separate manufacturer’s warranties.

Remember: you’re also covered by the Australian Consumer Law, which means we have a legal obligation to deliver your pergola with due skill and care (that is, in line with industry best practices and building codes), for the purposes you’ve told us about, and within a reasonable time.

How do you build a pergola attached to my house?

The exact fixture method varies from building to building, but, basically, we’ll attach one side of your pergola’s roof to your home’s exterior wall, then support the other side with posts or columns. Depending on your preferred design, we might integrate your pergola’s roof with your home’s, creating a visually seamless structure that looks like an original part of your house.

Do you do paving or tiling?

No, we don’t, but we can install pergolas over existing paved, tiled or concrete patios. If you’d like a referral to a tiler we trust, get in touch with us.

What happens if you build a pergola without a permit?

We never build without getting the necessary council approvals. If you built a pergola illegally through another builder, though, the consequences could be severe.

Under the Environmental Planning and Assessment Act 1979 (NSW), you could be issued with a maximum of a Tier 1 penalty – which could be up to $1 million in fines, followed by a $10,000 fine for each day the offence continues. The council could also issue a demolition order.

Even though it’s extremely unlikely that you’d be issued with the maximum penalty for something as minor as a pergola, you could still, realistically, face thousands in fines followed by an expensive (and lengthy) approval or modification process. It’s much, much easier to let your builder handle all council approvals on your behalf.
